For the developer carrying out notifiable (non-domestic) projects the areas specifically relating to the Construction (Design and Management) Regulations 2007 and its Health and Safety issues also need addressing, including meeting with current legislation and maintaining the appropriate records(H&S File) as work progresses. If it isn’t carried out correctly before, during and after construction it can leave you exposed to many problems and possibly heavy fines imposed by the Health and Safety Executive. As The Client you have a duty of care to ensure that all personnel working on your project are competent in the work they are carrying out, and are aware of the health and safety issues involved, not only in their work but of the safety of those working around them. You need to ensure your professional team are competent, suitably experienced, and make every effort to ensure that any possible risks within the building and the post construction maintenance of the project are recognized and either designed out, or if this is not possible, highlighted in the Health and Safety File for the scheme, with risk assessments concluding in a way of reducing the risk.
